Permits related to clean up from Hurricane Irene

All:

I spoke with DEC Commissioner Martens about the permitting issues raised earlier today at our meeting with Congressman Gibson. He responded that permits related to clean up from Hurricane Irene are not required if the clean up is necessary to protect health and property. However anyone doing clean up without a permit should call DEC after the fact. For cleanup that is not necessary for immediately protecting health or property but still storm related DEC can issue a general permit ASAP over the phone or with staff in the field. As far as nuisance permits, these are also waived under the same conditions.

Please share this with your Highway Superintendents or other participants of todays meeting.

This is applicable for the next 30 days but that can be extended by the state if necessary.

(Senator McDonald suggests that for any projects that would normally require a permit, it would be advisable to document the project on one page or less including how the project protected health and/or property.)
